Water Rights Update

Draft Preliminary Determination Completed

According to the Oregon Water Resources Department database the Preliminary Determination for Transfer Application T-11116 for Lincoln City’s change in the Point of Diversion (P.O.D.) of their existing Rock Creek water right was drafted today.  From reviewing other applications it appears that it can generally take 3-4 weeks from the time the draft is written to the time it is issued in the OWRD Weekly Notice.

Interested parties can easily follow the process;  you should download the Weekly Notice and scroll down to the section titled “Transfer Preliminary Determinations” to view the information related to Application T-11116. A Preliminary Determination provides the Department’s conclusion as to whether a proposed change in place of use, point of diversion or appropriation, or character of use of an existing water right should be approved.  Please see “How to Participate in a Water Rights Proceeding” for a detailed description of the remaining steps in this process.

October DLWID Board Meeting Report

The Devils Lake Water Improvement District held its October board meeting in the District offices on Thursday, October 7th, 2010.  The meeting was attended by approximately 7 interested parties.

Hot Topics.

Executive Session of the Board: The Board of Directors held an Executive Session preceding their regularly scheduled meeting.

New Meeting Date: The Board passed a resolution to move the next meeting to Thursday, November 11, 2010 due to conflicts of the Board and staff.

Public Comment: Members of the public provided comments on several items.  These included; an expression of appreciation of the efforts that have been  made by the district to enhance communications to the public including the Clearwater newsletter, direct mail, brochures, booklets, improvements to the website and the addition of Facebook and Twitter accounts. There was an expression of concern about why we are proceeding with the septic program based on the results of this summer’s Ecoli monitoring. One party was concerned about the current level on spending by the District. There was also one comment about the hydroplane races being two full days long last year. Several came to the meeting to inform the Board that the Union 50 Club is for sale. There was an expression that it would be a great opportunity for development by DLWID or others in the community. Attend the October DLWID Board Meeting

The Devils Lake Water Improvement District Board meeting will be held in its offices above Radio Shack Thursday October 7th at 6:00pm.  There is an Executive Session planned from 5:30 to 6:00 before the regular meeting.  The best way to stay informed is for all lake front homeowners and interested parties to attend these important meetings.

There are many topics of importance to lake residents on this month’s agenda.  These discussions include; an update on the lake level and need to lower the lake levels through the month of October to comply with the requirements of the impoundments permit, some rain recent rain events have challenged lake level management, a report on the availability of the Native Vegetation Guide, and an open discussion on modifications to the Devils Lake Plan. The board will make a final decision related to the RFP for an erosion study and provide updates on the Save or Shoreline program as well as efforts to determine the source of Ecoli on Thompson Creek.

Lake Level: October Update

Rain Event Adds Complexity to Management Plan

This is the first year that the DLWID has defined a method to comply with the requirements of their water impoundment permit and recent rain events have added a new level of complexity. This month’s DLWID Manager report provides a description of what to expect.

We have had significant rains this month and as a result managing the lake level has increased in complexity. This is the first year that we have had to account for the evaporation, and thus our methodology is a bit experimental. Obviously we are widely impacted by large rain events such as we had in mid September. In the five days starting on the 15th, we had nearly 4” or rain, with a full 1.7”
recorded the first day. In response the Lake Contractor pulled 2 north boards on 9-17-10 and pulled 4  boards north to south on 9-19-10. Overtime this appears to have compensated for the heavy rains as the most recent value sits very near the theoretic value.

September DLWID Board Meeting Report

The Devils Lake Water Improvement District held its September board meeting in the District offices on Thursday, September 2nd, 2010.  The meeting was attended by approximately 10 interested parties.

Hot Topics.

Executive Session of the Board: The Board of Directors held an Executive Session preceding their regularly scheduled meeting.

Public Comment: Members of the public provided comments on several items. These included; concerns on the cost of the Erosion Study, suggestions that the District should remove the logs currently in the river, a request for an explanation on the current lake level management plan, and some discussion on the District’s comments with OWRD on the City water rights application.

Lake Level Update: The Board discussed the current lake level, it was reported that the lake has been manually dropped in the month of August by the Lake Contractor and will continue to be dropped through the month of September. This is being done in an effort to comply with the conditions of our permit that state that inflow and outflow must be equal during this time of the year.  The request for a waiver on the inflow/outflow requirement was discussed and it appears that the District has repeatedly contacted Water Resources via email, on the topic and has not hear back.  The Board advised that it remains the policy of the District to begin the season at 9.53′ and continue to balance in accordance with the permit. Lake Level Update

Gradual Drop Planned for September

This is the first year that the DLWID has defined a method to comply with the requirements of their water impoundment permit that will result in the lake level dropping by approximately .40” from August 1st through October 1st.  This month’s DLWID Manager report provides a description of what to expect.

The lake has been manually dropped in the month of August by the Lake Contractor and will continue to be dropped through the month of September. This is being done in an effort to comply with the conditions of our permit that state that inflow and outflow must be equal during this time of the year. Effectively no additional water can be impounded in August and September, and in fact a slight decline in the lake height needs to be afforded to account for evaporation. This decline is on the order of 2/3” a week in August and a ½” a week in September.

Boards have been removed in an attempt to mimic this changing lake level. This is certainly an imprecise method, but the lake does respond over time with the removal of additional boards. I have included a graph of the actual height of the water and what should theoretically be the height of the water based on the evaporation calculations. On October1st, the lake level can again be increased, hence the last point on the theoretic line jumps back to the maximum height allowed under our permit of 9.53’. Continue reading

The board will discuss responses to the RFP for an erosion study and provide updates from the City on the Septic Tank Revitalization program as well as efforts to determine the source of Ecoli on Thompson Creek.  The Lake Manager will provide a report on progress relate to the Communications Plan and an update on the next phase of the Save Our Shorelines program to begin this fall.
